The Ministry of Public Works (MPW) is implementing various road projects in the Islamic Republic of Afghanistan. For implementation of the projects funded by the Asian Development Bank (ADB), a Program Management Office (PMO) of MPW willing to handle implementation related tasks that would include (a) procurement civil works and consultants’ services, (b) monitor the progress of day-to-day project implementation, (c) accord various approvals including approval for variations, extension of time, (including obtaining approvals of the donors,.), etc., (d) prepare progress reports (e) prepare withdrawal applications for disbursement, (f) maintain project accounts and complete loan financial records for auditing and (g) ensure compliance of various Loan and Grant covenants, etc. MPW wishes to recruit the following staff on contract basis for the PMO. As Senior Legal Advisor, The selected candidate may however, be required to work in other directorates of PMO/MPW, at the sole discretion of PMO/MPW. Candidates having experience in implementation of Project Management by the developing partners will be given preference.

The Ministry of Public Works, Islamic Republic of Afghanistan (MPW) requires legal advice and legal representation in relation to contracts for the rehabilitation and construction (including roads, bridges and other miscellaneous works) Projects in Afghanistan (the “Works”). As part of the dispute resolution process stated in the Contract, the Parties are to refer disputes to the Dispute Board. If either party is dissatisfied with the Dispute Board’s decision it can issue a notice of dissatisfaction and intention to commence Arbitration. Prior to the commencement of the Arbitration the Parties shall attempt to amicably resolve the dispute. The Legal adviser appointed by MPW will be required to coordinate directly with MPW, the Engineer, Dispute Management Team, Asian Development Bank and any other party so designated by MPW in relation to the services hereunder. The "Legal Advisor" is expected to support the Ministry on a broad range of issues, including but not limited to taking the day to day legal responsibilities and providing legal advice that includes all the aspects of the analysis, investigation and drafting process. He/she is responsible for providing support in discrete legal issues by advising the organization, drafting undertakings and structuring remedies for the relevant issues. This professional may also be engaged in helping to analyze and collect evidence and schedule staff hearings. Some of the responsibilities that need to be handled by him/her: Conduct legal analysis and research on various legal matters Provide advice on different legal issues and assist in drafting legal opinions, memoranda and other legal documents Be actively involved in preparing different acts and legal submissions and draft the authoritative legal opinions as well Conduct legal research by utilizing various resources and selecting the relevant material to analyze the legal information Assist in reviewing the legal material and any other relevant documents and to identify the most important issues that need to be sorted out on a priority basis Draw up formalities regarding the settlement of disputes and monitor the implementation of the legal clauses Strategic advice relating to the disputes arising out of the Contract Assist the management in reviewing the contracts, mediate dispute or advise about corporate management On-going contractual advice Advice relating to Dispute Board Referrals including representation and attendance in hearings when Referrals are made Advice relating to mediation and attendance of mediation meetings if requested Advice relating to recovery/protection of the advance payment guarantees Advice relating to Arbitration, including filing for arbitration, nomination of arbitrators and initiating the proceedings
